The
England and Wales Court of Appeal (EWCA) has allowed Simon Entwistle's challenge
to a pre-nuptial agreement he signed on the day he married Jenny
Helliwell.
The
couple were married in August 2019, after which they lived in a large residence
in Dubai given to Helliwell by her wealthy father Neil Helliwell. However, the
marriage lasted only three years and Entwistle was removed from the family home
in August 2022. There are no children.
Entwistle
applied for an English-law financial remedy settlement of GBP2.5 million,
alleging that his ex-wife had assets of GBP74 million. Helliwell rejected this,
claiming she only had GBP61 million, and applied for enforcement of the pre-nup
in which Entwistle had agreed he would receive 'no settlement upon divorce'.
During the ensuing proceedings, though, she made him an open offer of more than
GBP800,000.
In March 2025, Francis J in the England and Wales High Court upheld the pre-nup in its essential features, asserting that it was written in 'straightforward plain English' and Entwistle 'knew exactly what he was doing' when he signed it. Moreover, the marriage had been short with no issue. He allocated Entwistle a GBP400,000 capital sum to meet his needs, though that was reduced to GBP325,000 by a costs order made in Helliwell's favour.
